Appeal Update: Ali v. Serco Limited, Compass SNI Limited and the Secretary of State for the Home Department

This morning (9 July 2019) Lord Drummond Young granted our client’s motion to expedite her Inner House appeal (reclaiming motion) on the legality of “lock change” evictions in Scotland.

This is where an asylum seeker is evicted from his or her home, or threatened with eviction from his or her home, without a court order. Instead, people are simply told their locks will be changed and they will be evicted summarily. Serco plc introduced this practice in Glasgow last July.

The appeal will take place on Wednesday 28 August 2019 before the Second Division of the Inner House of the Court of Session. This is Scotland’s highest civil appellate court.

The Secretary of State for the Home Department indicated this morning the UK Government’s intention to lodge a cross-appeal challenging the application of the Human Rights Act 1998 to Serco Ltd and Compass SNI as private companies.
