Lady Hood has assigned two days for the substantive hearing of the judicial review of Fanning and another v. Secretary of State for Work and Pensions and the Scottish Ministers on Thursday 13th and Friday 14th March 2025, with the original diet of 15 January 2025 serving as a continued procedural hearing if required.
Instructing solicitor, Rachel Moon, Partner at Govan Law Centre (GLC), said on behalf of her clients: “This is the first winter fuel payment challenge to be heard at court across the UK, and has been raised by a couple from Coatbridge. They are pensioners with a small private pension and no savings or assets”.
“Mr and Mrs Fanning are proud life long trade union members and community activists, chairing the local tenants association and volunteer action groups”.
“They qualified for legal aid but with a hefty contribution. If they win their case, the benefit to this couple personally is £200. However by their resilience in taking this case, it could put money back into the pockets of millions of fuel poor pensioners across Scotland and the UK”.
